8. Data Processing for Photo Assignments & Online Galleries
For photo assignments, we process:
- Name, address, contact details
- Where applicable, information about the location, process, and date of the shoot
- Where applicable, image material containing personal references (e.g., portraits)
This data is used exclusively for the purpose of contract fulfilment, communication, and image delivery. The storage period is up to 7 years (statutory retention obligation).
Online Galleries (wfolio.com)
To deliver images, we use the platform wfolio.com (operator: Wfolio Sp. z o.o., Poland). Images are shared via password-protected links. According to the operator, the service is GDPR-compliant and hosts data within the EU. According to their privacy policy, no data is shared with third parties without your consent.

TERMS AND CONDITIONS
for Photography Services
1. General Provisions
1.1. These Terms and Conditions constitute a binding public offer made by the sole proprietor Timur Suleymanov (hereinafter referred to as the „Contractor“) for the provision of photography services to natural or legal persons (hereinafter referred to as the „Client“).
1.2. The Contractor provides services under the trademark „AdFoSt“, which is used to identify the photography services, the official website and the social media accounts of the Contractor.
1.3. The Contractor is entitled to perform the services personally or through photographers and other professionals engaged by the Contractor.
1.4. Booking a service via the website, confirmation of the session date and time, as well as any partial or full payment, shall constitute unconditional acceptance of these Terms and Conditions.
1.5. Upon acceptance of these Terms and Conditions, a binding contract is concluded between the Contractor and the Client.
2. Subject of the Contract
2.1. The subject of this contract is the provision of photography services, including in particular:
– conducting a photo session;
– selection and editing of photographs in accordance with the selected service package;
– delivery of the final photographs in digital form.
2.2. The scope, content and prices of the individual service packages are published on the Contractor’s website and form an integral part of this contract.
3. Performance of Services
3.1. The Client undertakes to provide accurate and complete contact details when making a booking.
3.2. After agreeing on the date, time and location of the photo session, payment shall be made in accordance with these Terms and Conditions.
3.3. The final photographs shall be delivered exclusively after full payment has been received.
3.4. The choice of technical means, photographic style and artistic execution shall be at the discretion of the Contractor or the photographer appointed by the Contractor.
3.5. Any preferences of the Client regarding style, clothing or visual concept must be communicated prior to the photo session. Otherwise, the execution shall be at the professional discretion of the Contractor.
3.6. In the event of late arrival of the Client, the duration of the photo session shall be reduced accordingly.
Failure of the Client to appear shall be deemed as performance of the service.
In such cases, there shall be no entitlement to a refund or rescheduling.
4. Selection and Delivery of Photographs
4.1. The photographs taken during the photo session shall be made available to the Client for selection via a secure online gallery.
4.2. The Client shall select the photographs to be edited within the scope of the selected service package.
4.3. Selection of additional photographs beyond the scope of the package shall be subject to additional payment in accordance with the current price list.
4.4. Unedited original files (RAW files) are not part of the service and shall only be provided upon separate agreement and additional payment.
5. Prices and Payment Terms
5.1. Prices
The prices for photography services are determined by the service package selected by the Client.
The prices published on the Contractor’s website at the time of booking shall apply.
Payment confirms the booking of the selected package and the reservation of the date, time and location of the photo session.
The Contractor is entitled to engage additional service providers (e.g. stylists, makeup artists) within the scope of the selected package, where provided for therein.
5.2. Deposit and Reservation (Vienna)
To secure the booking, the Client shall pay a deposit in the amount of EUR 50.00.
This deposit:
– is mandatory;
– shall be credited against the total price;
– is non-refundable if the Client cancels or reschedules the appointment, regardless of the reason.
Payment of the deposit confirms the booking and acceptance of these Terms and Conditions.
5.3. Balance Payment
The remaining balance shall be paid on the day of the photo session, unless otherwise agreed in writing.
In the event of non-payment or late payment, the Contractor is entitled:
– to refuse to conduct the photo session;
– to withhold delivery of the final photographs until full payment has been received.
5.4. Payment Methods
Payment may be made by:
– bank transfer;
– cashless payment (e.g. bank card, online payment);
– cash payment within the limits permitted by law.
6. Copyright and Rights of Use
6.1. Copyright in the photographs shall remain with the respective photographer.
6.2. The photographer grants the Contractor the right to use the photographs for the purpose of contract performance and delivery to the Client.
6.3. The Client shall receive a non-exclusive, non-transferable right to use the photographs for private purposes, unless otherwise agreed in writing.
6.4. Commercial use of the photographs shall only be permitted with the prior written consent of the Contractor and may be subject to additional remuneration.
6.5. The Contractor is entitled to use the photographs for self-promotion purposes (portfolio, website, social media), unless otherwise agreed in writing.
7. Liability
7.1. The Contractor shall not be liable for the Client’s subjective dissatisfaction with the artistic result, provided that the services have been performed in accordance with the contract.
7.2. The Contractor shall not be liable for failure or delay in performance caused by circumstances beyond the Contractor’s control.
7.3. The Contractor shall not be liable for any disadvantages resulting from incorrect or incomplete information provided by the Client.
8. Force Majeure
8.1. Neither party shall be liable for failure or delay in performance of its obligations due to force majeure events (e.g. natural disasters, governmental measures, technical failures).
9. Governing Law and Final Provisions
9.1. This contract shall be governed by the law of the country in which the services are provided.
9.2. The Contractor reserves the right to amend these Terms and Conditions at any time. The version published on the Contractor’s website shall be binding.
